TPPA bans rules on source code disclosure except for critical infrastructure

At least one article of a chapter of the Trans-Pacific Partnership Agreement, the text of which was released on Friday, appears to have the fingerprints of lobbyists from the proprietary software industry all over it.

And it seems to be directed at China, though it would be to the disadvantage of other countries too.

Chapter 14 (PDF) of the TPPA concerns itself with electronic commerce and article 17 deals with source code.

It reads as under:

1. No Party shall require the transfer of, or access to, source code of software owned by a person of another Party, as a condition for the import, distribution, sale or use of such software, or of products containing such software, in its territory.

2. For the purposes of this Article, software subject to paragraph 1 is limited to mass-market software or products containing such software and does not include software used for critical infrastructure. For the full article click here
